General Terms and Conditions of Business
Payment is due upon delivery and acceptance of the programs or services. 50% of the pro rata amount shall be billed upon delivery of programs. The remaining 50% is invoiced upon acceptance by the customer. In the case of service delivery, the pro rata amount (daily rate) shall become due immediately.
Conditions of acceptance
Acceptance shall take place no later than 4 weeks after delivery, or at the latest 3 weeks after elimination of all defects notified in writing.
The warranty period for programs is 6 months. All verifiable defects shall be remedied during this time free of charge. The customer shall only bear travel costs that may arise. Any and all further liability and warranty claims are excluded unless they are attributable to gross negligence or wilful misconduct. Unless expressly agreed herein, defects affecting the Siemens PLM Software shall not be eliminated through the functions of the application programs.
Free cancellation of services is possible up to two weeks before their start. Thereafter, 30% of the registration fees shall be charged. In the event of justified postponement, this fee shall be payable within the scope of the final invoice due at the time. We reserve the right to cancel training and propose an alternative date if the number of participants falls below the minimum of 3 persons.
Place of jurisdiction, applicable law
Swiss law applies exclusively.
The exclusive place of jurisdiction for any disputes shall be the registered office of JANUS Engineering AG.
